Prices must be stated in Appendix 3A - Schedule of Prices (document no. 25/16717-15). Tenderers must enter prices in the specified yellow columns in both the ‘Con-tract – Total’ and ‘Price Regulation’ sheets. Prices must be stated in EUR and exclusive of VAT but inclusive of all other expenses associated with the pur-chase. When evaluating ‘Price’, the Contracting Authority will evaluate the total cost for evaluation purposes, including all prices entered in the specified yellow columns in Appendix 3A - Schedule of Prices (document no. 25/16717-15)55%Technical Solution The evaluation will be based on a description of the Technical Solution offered. The description should demonstrate the technical level of the solution, and include these elements: Description of the complete cable design, including engi-neering, design, documentation, calculations, routine and sample testing setup, and the robustness of the mechan-ical design, in accordance with Appendix 2 (132 kV cable supply – costumer's requirements, technical general requirements), Section 9.1.2 of document No. 25/16717-12 and the filled in document No. 25/16717-13 “Appen-dix 2A, Underground AC cable - handover specification - Cables” Any ambiguities, missing information or uncertainties relating to the performance or characteristics of the offered solution may have a negative effect on the ten-der evaluation. The Contracting Authority will focus on the documentation provided by the tenderer who are encouraged to submit detailed and thorough responses as the below-listed elements will be of particular importance in the evaluation: Cable design: The quality of the engineering documentation (based on design documentation, calculations, values, and state-ments), including the extent to which this provides evidence that the cable is fit for purpose according to the Technical Requirements. Further, the robustness of the solution including documentation and calculations supporting this will be favored. In this context it will be considered positive if the solution provides evidence of having very robust jackets, a high level of pulling force, and provides evidence of water-prof design20%Production and delivery Schedule As part of the tender, the tenderer must state the max-imum guaranteed delivery time for the delivery of cables system, calculated from contract commencement date until final delivery. As part of the tender submission, the tenderer must include a production and delivery schedule plan that outlines a robust and realistic production and delivery plan, including: • A binding guaranteed delivery date • A production and delivery schedule demonstrat-ing how production and delivery will be planned and executed Delivery and production must be completed no later than 22 June 2027. The submitted delivery time is considered guaranteed. The evaluation of the sub-criterion “production and delivery schedule” will be based on the guaranteed delivery time submitted by the tenderer. If the tenderer submits a production and delivery schedule with a delivery date later than 22 June 2027, the tender will be considered non-compliant and will therefore be rejected The tenderers may, at the earliest, deliver the manufactured cables two months prior to the final delivery date, set at 22 June 202715%Contract Terms For the evaluation of the sub-criteria the tenderer is allowed to propose deviations to the elements of the contract identified as competitive elements in the con-tract terms. The contract terms consist of: Contract Agreement, doc.no. 25/16717-4 Appendix 1 [General Terms and Conditions for Purchase], doc.no. 25/16717-6 Master Time Schedule, doc. no. 25/16717-16 The deviations should be enclosed in the clarification list c.f. doc.no. 25/16717-22 and be included in the spread-sheet marked “Legal clarification”. The proposed deviations should be explicit and with ex-planation as to why they are made. Contract terms listed in section 3.7.1 are mandatory parts and deviations to these are not accepted. The tendered contract must be performed based on the contract terms. The tenderer is allowed to propose explicit and well-explained deviations to the following listed competitive elements: In the Contract Agreement for 132 kV Cables Route Re-structuring E20 Amager Motorway, doc. no. 25/16717-4: • Section 4.2 in terms of:  Clauses and sub-clauses in section 4.2, which are part of the competitive el-ements for Appendix 1. • Section 5 [Contract data] in terms of:  Section 5, sub-clause 12.1 (Liquidated damages)  Section 5, sub-clause 12.1 (Maximum amount of liquidated damages)  Section 5, sub-clause 13.1 (Defects Notification Period)  Section 5, sub-clause 13.4 (Defects Notification Period for replaced and repaired parts)  Section 5, sub-clause 13.4 (Maximum Defects Notification period)  Section 5, sub-clause 14.2 (Limitation of liability) In Appendix 1 [General Terms and Conditions for Purchase], doc.no. 25/16717-6: • Clause 9 (Time of Delivery) • Clause 11 (Intellectual property rights) • Clause 12 (Late-delivery or non-delivery) • Clause 13 (Defects and remedies) • Clause 14 (Limitation of liability) • Clause 15 (Product liability towards Cus-tomer) • Clause 17 (Indemnification) • Sub-Clause 20.4 (only the daily penalty amount) • Clause 25 (Termination) • Clause 26 (Termination for convenience) Deviations to these elements will be included in the evaluation and it is noted that any deviations may lead to a reduction of the score depending on the content, clarity, and consequence of the deviation. In this regard it is explicitly noted that deviations which are intended to limit liability and shift the financial risk in favour of the tenderer will be of particular importance in the evaluation. If the tenderer has no deviations to the contract terms, the maximum score of 10 will be awarded. An overall evaluation for each lot will be made of this sub-criterion10%

The Contracting Authority wants to purchase 132 kV AC underground cables for the following project: “400-132 kV Cable route restructuring E20 Amager motorway” close to Copenhagen, Denmark. The amount of 132 kV AC underground cables is stated as (9 x 1500 m) 13.5 kilometres single-core cables. The 132 kV cables will be installed in the ground by the Costumer. A third-party accessory provider will perform jointing. Thereby the contract only concerns supply of cable cores. For further details regarding the purchase, reference is made to the tender documents. The value of the contract is expected to amount to EUR 1,140,000.
