Comprehensive support, maintenance, and development of the ImmoGIS web-based geoinformation system, including 3rd-level support, bug fixes, updates, patches, and continuous adaptation to new requirements. The contractor must provide its own support and development environments and cooperate with LIG and Dataport (IT service provider). The contract is a framework agreement with no minimum commitment; maximum value is 150% of the awarded contract price.

Die Wertung der Angebote erfolgt im hiesigen Vergabeverfahren nach der erweiterten Richtwertmethode (UfAB 2018). Der Schwankungsbereich beträgt 10%. Als wirtschaftlichstes Angebot wird das Angebot angesehen, das von den im Schwankungsbereich liegenden Angeboten den höchsten Leistungspunktwert (L) erzielt hat. Erlangen mehrere Angebote im Rahmen der Bewertung der Wirtschaftlichkeit nach Maßgabe dieser Vorgaben den ersten Rang (= „Punktgleichheit bei der Leistungspunktzahl L mehrerer im Schwankungsbereich befindlicher Angebote“) wird als sekundäres Entscheidungskriterium die höchste Leistungspunktzahl beim Kriterium „Konzept Releasemanagement“ herangezogen. Besteht danach weiterhin Gleichstand, entscheidet als tertiäres Entscheidungskriterium der Preis (niedrigster Gesamtangebotspreis brutto). Sollte auch unter Beachtung des tertiären Entscheidungskriteriums zwischen zwei qualitativ gleichen Angeboten Parität bestehen („Neben der Punktgleichheit bei der Leistungspunktzahl L auch Preisgleichheit und damit letztlich Gleichheit bei der Kennzahl Z“), entscheidet über die Zuschlagsentscheidung – soweit eine unzulässige Absprache nicht angenommen werden kann – das Los. Gegenstand der Ausschreibung ist der Abschluss eines Support-, Wartungs- und Entwicklungsvertrags für das webbasierte Geoinformationssystem „ImmoGIS“ des Landesbetriebs Immobilienmanagement und Grundvermögen (LIG) der Freien und Hansestadt Hamburg. Der Auftrag umfasst die ganzheitliche Betreuung der Individualsoftware ImmoGIS, insbesondere: 3rd-Level-Support für die ImmoGIS-Individualsoftware, Wartung und Pflege der Software (Fehlerbehebung, Updates, Patches), Kontinuierliche Weiterentwicklung und Anpassung der Anwendung an neue fachliche und technische Anforderungen. Der Auftragnehmer stellt hierfür eigene Support- und Entwicklungsumgebungen bereit und arbeitet eng mit dem Auftraggeber (LIG) und dem IT-Dienstleister Dataport, bei dem das Verfahren betrieben wird, zusammen. Für die Leistungsabrufe aus diesem Vertrag maßgebend ist der tatsächliche Bedarf. Eine abschließende verbindliche Festlegung ist mit dieser Bedarfsschätzung nicht verbunden, so dass keine (Mindest-)Abnahmeverpflichtung besteht. Der Auftraggeber wird auf Grundlage der Entscheidung C-23/20 des Europäischen Gerichtshofs vom 17.06.2021 jedoch maximal bis zu einem Höchstwert in Höhe von 150% des bezuschlagten Auftragswertes Leistungen aus diesem Rahmenvertrag abrufen. Wird während der Vertragslaufzeit der Gesamt-Höchstwert erreicht, ist der Auftraggeber berechtigt, den Vertrag fristlos zu kündigen.
